• An individual who submitted late-filing requests of the original Pigford consent decree after 10/12/1999 but before 6/19/2008,

AND

• The request did not receive a determination on the merits

OR

• The heir or legal representative of someone who fits the above description

• The Pigford claim was approved or denied

• The Pigford claim was determined defective by the Facilitator OR

• The late-filing request was approved and then the individual failed to file a claim on time

That the farmer/rancher:

  • Is an African American that farmed or attempted to farm between 1/1/1981-12/31/1996
  • Owned, leased, or attempted to own or lease, farm land during that period
  • Applied or attempted to apply for USDA loans
  • The loan was denied, provided late, provided at a lesser amount, or provided with unfair terms
  • Suffered economic damage due to the denial
  • Filed or attempted to file a discrimination complaint with the USDA before 7/1/1997

• Up to $50,000

• Potential loan forgiveness of USDA loans

• A tax award to offset any new taxes
